Papers for Legal Funding Loans


There is no question that everyone involved in a legal funding transaction wants to get the deal done as soon as possible. For the lender it means securing the client and for the client it means getting the money they need. While some companies make you believe there is a long process involved in evaluating an application, it’s not always the case. What are the papers?

When a person applies for a legal loan they will be required to allow our company or partners to review the paperwork on the case. The papers are also referred to as case documentation. These papers will be used to assess the viability of the advance.

What types of papers are needed?

The paperwork may be different depending upon the case type and in some cases certain paperwork may not exist. The typical request for papers against a personal injury claim is typically the complaint, police and accident report, medical records and defendants insurance information. There are many cases in which the attorney may not have certain paperwork. In this case it will require a follow-up call to discuss the case.

Who reviews the paperwork?

The person that reviews the papers on a lawsuit is an underwriter. The underwriter may be an attorney or ex-insurance adjuster. The underwriter may represent a hedge fund, investment company, institutional fund or private investor that outsources the service. It will always depend upon the company.

Are papers needed?

In most cases yes. There should be some type of paperwork available on the case. We do come across cases in which an accident may have recently happened and an attorney was recently hired. In this case, we may request speaking directly to the attorney to get a better feel for the case.
